Terms of Service

• Adult contract: Users under 18 cannot form a contract with our platform. The adult who creates the account assumes all legal and financial responsibility for how any child uses the lessons and the Service.
• AI content disclaimer: Educational modules are curated and structurally bounded. Because content may leverage AI generation, all materials are provided "as-is." We are not liable for technical hallucinations or factual inaccuracies in AI-assisted text.
• XP and virtual goods: Experience points (XP), learning levels, streaks, and badges are strictly for motivational purposes and hold zero real-world cash or monetary value. They cannot be redeemed or transferred and are forfeited when an account closes.
• Disputes: Governed by New Jersey law; binding individual AAA arbitration with a class action waiver (30-day opt-out available — see Section 19).

• Account Holder — the adult parent or legal guardian who registers, agrees to these Terms and the Privacy Policy, and controls billing and child profiles.
• Child profile / learner — a preset learner profile you create for a child in your household. Learners are authorized users only; they are not parties to this Agreement.
• You — the Account Holder only, unless the context clearly refers to your household generally.

Subject to this Agreement, we grant the Account Holder a limited right to access the Service for personal, non-commercial family use within one household. The Service is not for classroom, school, district, tutoring-center, or other institutional use unless we agree in writing. You may not sublicense, resell, or share paid access outside your household.

We may change, suspend, or discontinue features at any time, with or without notice, except where law requires otherwise.

Users under 18 cannot form a contract with CROODI. You must be at least 18 years old (or the age of majority where you live) to register, subscribe, and agree to these Terms. The Account Holder is the sole contracting party and assumes all responsibility for how any child uses the Service.

Learners ages 5–16 may use the Service only through child profiles you create and manage, including a preset learner character (not your child's real name), an age group (5–7, 8–11, or 12–16), and a profile PIN you set for session access on shared devices.

This Agreement is void where prohibited by law.

By registering, subscribing, or adding a child profile, you represent and warrant that:

• You are the parent or legal guardian of each child who will use a child profile under your account, or you have lawful authority to provide their access;
• You are at least 18 years old (or the age of majority in your jurisdiction) and have legal capacity to enter this Agreement;
• All registration, billing, and profile information you provide is accurate and current;
• You will not register on behalf of a minor, allow a minor to register as Account Holder, or misrepresent your age or guardian status;
• You have read and agree to the then-current Privacy Policy, including how we collect and use child profile and learning activity data.

If any representation is untrue, we may suspend or terminate your account without refund, to the extent permitted by law.

As the account holder, you agree to:

• Provide accurate registration and billing information and keep it current;
• Supervise use of child profiles and safeguard parent credentials and profile PINs;
• Accept full legal and financial responsibility for all activity under your account;
• Accept full legal and financial responsibility for all acts and omissions of any minor who accesses the Service through a child profile you create, including after a profile PIN is entered on your devices;
• Not allow misuse of the Service, including attempts to bypass safety features or share access with unauthorized persons;
• Update a child's age group when their learning needs change materially.

You are responsible for activity that occurs after a child profile is unlocked with the correct PIN on your devices. Each time you add or reconfigure a child profile, you reaffirm that you are that child's parent or legal guardian and agree to the then-current Terms and Privacy Policy.

CROODI provides structured AI literacy lessons, guided quizzes, progress tracking, and gamification (XP, levels, badges) through a curriculum interface.

No learner AI playground. Children do not receive a general-purpose AI chat, image generator, or open prompt lab. They interact through fixed lesson and quiz flows (for example, multiple-choice answers), not by submitting arbitrary messages to an AI system.

Parents manage profiles, subscriptions, and deletion from parent areas such as Manage profiles and Billing.

Access to paid features requires a monthly subscription as shown at checkout (for example,Individual or Family plan). Prices may change upon notice (email or in-app). Fees are exclusive of applicable taxes unless stated otherwise; you are responsible for any taxes imposed on your purchase.

Billing and payment

We bill through Stripe. You authorize us and Stripe to charge your selected payment method for applicable fees. You agree to maintain accurate billing information. Except as required by law or as stated below, fees are non-refundable.

Automatic renewal

Subscriptions renew for successive 30-day periods at the then-current price unless you cancel before the renewal date. Additional learner slots are separate monthly subscriptions at Individual pricing.

YOU ACKNOWLEDGE THAT MONTHLY PLANS RENEW AUTOMATICALLY UNLESS CANCELED. Cancel through the Billing area / Stripe customer portal in the app, or email croodihelp@gmail.com before the end of your current period to avoid the next charge. If payment fails, we may suspend access and retry charging per Stripe's rules.

After cancellation, you may use the Service through the end of the then-current paid period.

Refunds

Payments are generally non-refundable, including for partially used periods. We may grant refunds or credits at our sole discretion in individual cases; prior grants do not obligate us to grant future refunds. Statutory rights in your jurisdiction are not affected where applicable.

Promotions

Free trials, discounts, or other promotions may be offered with separate terms. Unless stated otherwise, a promotion may convert to a paid subscription when the promotional period ends. Cancel before the promotion ends if you do not want to be charged.

Content and materials on the Service (text, graphics, curriculum, software, logos, and compilations) are owned by CROODI or licensors and protected by copyright and other laws.

Except for the limited license in this Agreement, you may not sell, rent, modify, distribute, copy, publicly display, or create derivative works from Service content without our prior written permission.

We grant the account holder a personal, non-exclusive, non-transferable, revocable license to use the Service for family learning during an active subscription.

CROODI is not a public social network. Children do not post open commentary or upload media for other users. The Service may process limited responses within lessons and quizzes (for example, selected quiz answers) solely to operate progress tracking and deliver the curriculum.

If you contact support or submit feedback as the account holder, you represent that you have the right to provide that information and grant us a license to use it to operate and improve the Service. We may remove content that violates law or these Terms.

If we provide downloadable or embedded software, we grant you a personal, non-transferable, non-sublicensable license to use it only as directed for personal, non-commercial use of the Service. You may not reverse engineer, decompile, or redistribute the software except where applicable law expressly allows.

You agree not to:

• Scrape, crawl, mine, or use automated tools to access the Service or extract data, including for training AI or machine learning models;
• Reverse engineer, probe vulnerabilities, or attempt unauthorized access to accounts, systems, or networks;
• Extract system prompts, bypass safety filters, or misuse quiz or lesson interfaces to generate abusive, illegal, or inappropriate content;
• Impersonate others, harass users, or distribute malware or illegal material;
• Share parent credentials, sell access, or overload our infrastructure;
• Use the Service for any unlawful purpose or in violation of this Agreement.

We may bar such activity and terminate accounts without notice where appropriate.

Lessons and quizzes may be authored or assisted using internal tools with age-band guardrails. Our educational modules are curated and structurally bounded; however, because content may leverage AI generation models, all materials are provided "as-is" for educational purposes. We do not warrant that every explanation is complete or error-free. The platform is not liable for technical hallucinations or factual inaccuracies in AI-assisted text, unexpected wording in curriculum content, or technical interruptions. You are responsible for supervising your child and judging appropriateness. The Service is not a substitute for school, tutoring, or professional advice.

Experience points (XP), learning levels, streaks, badges, and similar items are strictly for motivational purposes, have zero real-world cash or monetary value, are non-transferable, cannot be redeemed for money or goods, and are forfeited when an account or profile is deleted or terminated.

You must register with accurate, complete information and keep your parent password and account credentials confidential. You are responsible for activity under your account. We may refuse or cancel registrations that violate these Terms or impersonate others.

The Service may link to third-party sites or services (including Stripe). We do not control and are not responsible for third-party content or practices. Your use of third-party services is at your own risk and subject to their terms.

You will defend, indemnify, and hold harmless CROODI, Croodi LLC, and our affiliates, officers, directors, employees, and agents from claims, liabilities, and expenses (including reasonable attorneys' fees) arising from your use or misuse of the Service, your account, any child profile you create, any use of the Service by a minor under your account (including after PIN unlock), your breach of this Agreement or the Privacy Policy, your false or misleading representations about your age or guardian status, or your violation of law or third-party rights.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE IS AT YOUR SOLE RISK.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CROODI AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM THE SERVICE OR THIS AGREEMENT.

OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES WILL NOT EXCEED THE GREATER OF (I) FEES YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (II) FIVE HUNDRED U.S. DOLLARS (USD $500), EXCEPT WHERE LAW REQUIRES OTHERWISE.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

You may stop using the Service and request account deletion as described in our Privacy Policy. We may suspend or terminate access at any time for breach, non-payment, fraud, safety, or legal reasons, with or without notice where permitted.

Upon termination, your license ends and virtual rewards are forfeited. Sections that by nature should survive (fees owed, indemnity, disclaimers, limits of liability, arbitration, governing law) survive.

You agree not to use or export any part of the Service except in compliance with U.S. and other applicable export control and sanctions laws.

Our Privacy Policy at /privacy is incorporated by reference. It describes how we handle parent and child information, including preset learner profiles, age groups, and parental rights. If these Terms and the Privacy Policy conflict on privacy matters, the Privacy Policy controls.

Dispute resolution and governing law. These Terms of Service and any dispute arising out of or related to our digital services shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict-of-law principles, except where consumer protection laws in your place of residence require otherwise.

Agreement to arbitrate. You and Croodi LLC agree that all disputes, claims, or controversies arising out of or relating to these Terms, the use of the website, or the digital services provided, shall be resolved exclusively through binding individual arbitration.

By agreeing to these Terms, you are giving up your right to go to court to assert or defend your rights under this contract. You also explicitly waive your right to a trial by jury.

Arbitration procedures and venue. The arbitration shall be administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules. The Federal Arbitration Act governs the interpretation and enforcement of this section.

• Location: The arbitration shall take place in Middlesex County, New Jersey, or may be conducted virtually by mutual agreement.
• Costs: Payment of filing, administration, and arbitrator fees will be governed by the AAA's rules. Croodi LLC will reimburse those fees for claims totaling less than USD $10,000 unless the arbitrator determines the claims are frivolous.

Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property or prevent unauthorized access, without first submitting that limited request to arbitration.

Class action waiver: You and Croodi LLC agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person's claims or otherwise preside over any form of a representative or class proceeding.

30-day opt-out right. You may opt out of this mandatory arbitration agreement within thirty (30) days of first using the website or purchasing our services. To opt out, send a clear written notice to croodihelp@gmail.com that includes your full name and a statement that you wish to opt out of the arbitration provision. If you opt out, the governing law above still applies; disputes may be brought in courts located in New Jersey where permitted by law.

Disputes between users. You are responsible for interactions within your household. You release CROODI from claims arising from disputes with other users of your account, to the extent permitted by law (including California Civil Code § 1542 where applicable).

Electronic communications. You consent to receive agreements, notices, and disclosures electronically (email or in-app).

Copyright. All Service content is protected by copyright. Unauthorized copying is prohibited.

If any provision is unenforceable, the remainder stays in effect. You may not assign this Agreement without our consent; we may assign it. This Agreement is the entire agreement regarding the Service and supersedes prior understandings on the subject.

We may update these Terms by posting a revised version with a new last-updated date. Material changes may be communicated to account holders where required.
